The ACLU has filed a lawsuit on behalf of the Midwest Innocence Project (MIP) against the Clay County Prosecutor’s Office after that office denied MIP’s records request made pursuant to the Sunshine Law. MIP seeks records in the possession of the Clay County Prosecutor’s Office that MIP needs to investigate a claim of innocence. The Clay County Prosecutor’s Office has denied the record request citing to a constitutional provision and statute protecting victim’s rights. Despite MIP having no contact with the victim’s family, the Clay County Prosecutor’s Office denied the request and forced MIP to seek a court order.
